Mutual Rescission and Release Agreement

_____________________________ (hereafter "Party 1") and ________________________ (hereafter "Party 2"), having previously signed a contract that is now subject to termination, both agree to the following:

That the two parties independently wish to terminate the contract signed by both parties on {date}, dictating that {brief description of contract and purpose}.

That neither party has been threatened, coerced, or forced to seek termination of said contract.

That neither party has fulfilled the requirements dictated by the terms of the contract.

Therefore, the contract mentioned above is hereby terminated, and all terms and conditions deemed null and void. Both parties return to the state previously held before the contract was signed. Neither party shall hold the other to the requirements found in the contract, and all payments, benefits, or gains made through the contract shall be returned to the previous owner.

Furthermore, neither party shall hold the other liable for any claims that have arisen or may arise from the terms or conditions of the contract.

In witness to their agreement to the terms of this contract, the parties affix their signatures below:
